What Is a Misdemeanor in Florida?

In Florida, misdemeanors are criminal offenses punishable by up to one year in jail and/or a fine. While they are less serious than felonies, they still carry long-term consequences if not handled properly.

Common misdemeanor charges include:

  • Petit theft (often called “petty theft") or shoplifting
  • Simple battery or assault
  • Disorderly conduct
  • Criminal mischief (vandalism)
  • Trespassing
  • Possession of marijuana (under 20 grams)
  • Driving with a suspended license

These cases may seem straightforward, but they can spiral quickly—especially if they involve prior convictions, injuries, or complications like no-contact orders or restraining orders. Even one conviction can follow you for years.

What Happens If You’re Convicted of a Misdemeanor?

Generally speaking, misdemeanors are crimes that are punishable by less than a year in jail or on supervision (first degree misdemeanors).  Second degree misdemeanors are punishable by up to 60 days in jail and up to 6 months of probation, generally. Some other crimes, however, have special maximum penalties and you should speak to an attorney to make sure you are advised of the correct minimum and maximum sentences on these offenses.

Misdemeanor offenses can impact your job, immigration status, child custody disputes, apartment/housing rentals, loans, and college admission.  While the charge may not sound serious, the impact can certainly be.

  • Up to 12 months in jail
