When a Misunderstanding Turns Into an Arrest, You Deserve Someone Without Judgement

An aggravated assault charge can change everything in an instant. You may not have intended to hurt anyone. Maybe you were scared. Maybe you were trying to protect yourself or someone else. Perhaps things simply got out of hand. But now you’re facing a serious felony—and you need someone who will listen, understand, and stand beside you as you navigate what comes next.

My name is Kathleen Bogenschutz, I’m a defense attorney. I represent people accused of serious crimes throughout Tallahassee and across North Florida. I know that these cases are rarely black and white. I bring deep care, strong legal strategy, and unwavering support to every person who walks through my door. You are more than the charges against you—and I treat you that way.

What Is Aggravated Assault Under Florida Law?

In Florida, aggravated assault is an intentional threat—by word or action—with a deadly weapon or the intent to commit a felony. Unlike battery, there doesn't have to be physical contact. Just the perception of a threat, when combined with a weapon or intent to do serious harm, can lead to a felony charge.

Examples might include:

  • Raising a firearm during a heated argument
  • Swinging a bat or object in a threatening manner
  • Verbally threatening someone while holding a weapon
  • Accusations of threatening law enforcement or a protected class

Aggravated assault is classified as a third-degree felony, and if a firearm or certain enhancements apply, mandatory prison sentences can come into play.

Penalties for Aggravated Assault in Florida

Aggravated assault can carry life-altering penalties, including:

  • Up to 5 years in prison (or more with firearm enhancements)
  • Up to 5 years of probation
  • Fines up to $5,000
  • Mandatory minimums under Florida’s 10-20-Life law (if a firearm was discharged)
  • Loss of civil rights such as voting and firearm ownership
  • A permanent felony record that can affect employment and housing

These penalties are serious—but they aren’t the end of the story. With the right defense, it’s often possible to reduce charges or negotiate alternatives.

Building a Strong Defense

I approach every aggravated assault case with the goal of telling your full story—not just the version found in the police report. I investigate what really happened, challenge weak or inconsistent evidence, and explore defenses such as:

  • Self-defense or defense of others
  • Lack of intent or no credible threat
  • False accusations or misidentification
  • No deadly weapon involved
  • Stand Your Ground protections
  • Violation of your constitutional rights during the arrest

I am deeply strategic, but just as importantly, I’m someone you can talk to. I’m there for you during the hardest conversations and decisions, helping you move forward with clarity and confidence.

This Charge Doesn’t Have to Define You

One heated moment doesn’t make you a violent person. I am a strong believer in second chances, and I know that the justice system doesn’t always get the full picture. That’s why I am committed to standing between you and a system that can feel cold and overwhelming.

When you work with me, you’re not just hiring an attorney—you’re gaining an ally.
